Terms & Conditions (revised 2-4-2020)

The unexpected appearance of covid-19 has prompted this addition to terms & conditions.

That for ANY communicable infections disease organisms, PC-Techniques cannot offer that during a visit to your premises a communicable infectious organism won't transferred to the premises or a person who uses the premises. Therefore no liability will be accepted for any consequence arising from a visit to customer premises.

In agreeing to a visit you are expected to endeavour that PC Techniques staff are not exposed to infectious communicable diseases whilst on your premises.

The following are terms of a legal agreement between you and PC Techniques.

1.             Authorisation - The client authorises PC Techniques to conduct an evaluation of the machine to determine the nature of work(s) required and provide an estimate of repair cost and work duration. The evaluation period (up to 30 minutes maximum) is not chargeable and the client will be advised of options, no work will be done following the 30 minute period without authorisation from the client. It is the clients responsibility to ensure they have full understanding of the costs estimated or quoted by PC Techniques when authorising work to be done.

The client authorises PC Techniques, its employees, and agents, to receive and transport this media/equipment/data to, from and between their facilities, and will ensure that they have adequate copies (backups) of all data required for their purposes.

For any reinstallation of customer applications we must be provided with software that has originated from legal sources and be complete with legitimate product keys.

2.             Legal Rights - The client is the legal owner or authorised representative of the legal owner of the property and all data and components contained therein.

3.             Limitation of Liability - PC Techniques shall not be liable for any claims regarding the functioning of equipment or media or the condition or existence of data on storage media supplied before, during or after service.

Under no circumstances will PC Techniques be liable for any damage to a computer,  loss of data, loss of revenue or profits, or any special, incidental, contingent, or consequential damages however caused, before, during or after service This will apply also if PC Techniques has been advised of the possibility of damages or loss to persons or property. PC Techniques accepts no liability of any kind with respect to provided services, including any negligence on its part.

The client and PC Techniques agree that the sole and exclusive remedy for unsatisfactory work or data shall be, at PC Techniques option, additional attempts by PC Techniques to recover satisfactory data or refund of the amount paid by the client. The parties acknowledge that the price of PC Techniques services would be much greater if PC Techniques undertook more extensive liability.

The client must remove all hazards before an engineer visits and be  aware of the inherent risks of injury and property damage involved in laptop/desktop repair, including without limitation, risks due to destruction or damage to the machine, media, or data and inability to repair the machine or recover data, including those that may result from the negligence of PC Techniques, and assumes any and all known risks of injury and property damage that may result. The client must ensure the safety of PC Techniques staff at all  times.

Vulnerable Persons – The client must ensure that adequate supervision of any vulnerable persons at their premises where that person(s) are involved with a visit of PC Techniques.

The client will ensure that any mains power supplied to machines is suitable for the type of equipment in use (i.e voltage and current are sufficient and reliable). The client must ensure that all relevant equipment is fully accessible for the staff of PC Techniques to perform their duties, should this not be so the equipment will not be worked on and a charge for abortive visit may apply.

Advice – All advice and opinion is given in good faith and without any warranty. The client assumes responsibility for checking and evaluating that advice before taking any action. PC Techniques will not be liable for advice that is later shown to be inaccurate or is misunderstood by the client.

4.             Confidentiality - PC Techniques agrees not to disclose any  information or data files supplied with, stored on, or recovered from client's equipment except to employees or agents of PC Techniques subject to confidentiality agreements, or as required by law.

5.             Payment - Payment is due in full upon completion of completed works unless a pre existing special arrangement exists.  The client is financially responsible for any shipping costs, custom duties and taxes to and from PC Techniques

6.             Warranty - 30 days warranty for work done on laptops / desktops that PC Techniques has repaired but does not cover faults caused by accident, neglect, misuse or normal wear and tear or other cause external to the repaired device. PC Techniques makes no warranty on data, express or implied, and PC Techniques disclaims any data warranty of any kind.  Any hardware supplied by PC Techniques will be covered by the manufacturer’s warranty, however travelling and installation costs may apply at PC Techniques discretion.

7.             Agreement - The parties shall submit all disputes relating to this Agreement (whether contract, tort or both) to arbitration. Either party may enforce the award of the arbitrator in a Court of competent jurisdiction. The parties understand that they are waiving their rights to a jury trial.

8.             Special Offer - PC Techniques will spend up to 30 minutes (per visit) discussing any issues with the PC system(s) or any learning (tuition) requirements. This introduction period is normally free of charge,(excluding any relevant travel costs) but does not include any fault or upgrade evaluation work or introductory guidance (tuition). This offer applies to the Stroud area only (Stroud, Nailsworth, Chalford, Slad, Brookthorpe and Painswick and their near locations) PC Techniques reserves the right to charge mileage for destinations beyond those above, please ask for details. This offer may be withdrawn at any time.

9.             Data Storage  - Customers agree by purchasing the offsite data storage service that PC Techniques will store customers data sets on its own storage media and this data will be encrypted and that the customer will safely retain the encryption key. In the event of a data restore being required the customer undertakes to have available the encryption key and understands that should this not be available this data will not be usable. PC Techniques  makes no warranty on customers data being usable should an encryption key not be available.

10.           Hardware Re-Use. As part of its operating ethos PC Techniques offers to arrange for new owners of equipment to be sought and may arrange for the prospective new owner to contact the existing owner if this is desired. PC Techniques will not charge for this and will not be liable for resulting negotiations or outcomes of this free service.

11.           Resale of equipment – PC Techniques may at times offer used equipment for re-sale. PC Techniques sells these articles on an “as seen” basis and makes no warranty implied or other for the hardware or software functionality. Any opinions offered as guidance on the suitability of sold items are made in good faith and items bought are done so at the customers own risk.


 Disclaimer

Before following any advice or installing any software or hardware recommended or mentioned by PC Techniques , you are strongly urged to perform a full backup of your data and system files to a separate device media (i.e CD/DVD, Online Backup, External Hard drive or Server drive.

PC Techniques shall under no circumstances be responsible for data loss or consequential other loss.

Services and products offered  may be modified or discontinued without prior notice. Prices for services or products are subject to change without prior notice


Tuition & other Guidance Given

Although all attempts are made to provide accurate, current and reliable information, should errors occur in opinions or guidance offered by PC Techniques or should it be misunderstood by the recipient the enquirer  accepts that information is given offered in good faith and PC Techniques will not be liable for any misunderstanding or loss/actions resulting from information given.

PC Techniques expressly denies any warranty of the accuracy, reliability, or timeliness of any information made available, and shall not be held liable for any losses caused by reliance upon the accuracy, reliability, or timeliness of the information.

A person who relies upon information made available on this Web site does so at their own risk.
